At the outset learned counsel for the applicants seeks leave to amend application by correcting the date of judgment and decree passed in RCA No. 28/2019. Leave is granted. Amendment to be carried out forthwith.

This application is for condonation of delay of 726 days in filing second appeal against the judgment and decree dated 16/07/2019 passed in RCA No. 28/2019. There is no dispute about the fact that the judgment in question was passed during Covid-19 Pandemic when there were restrictions the movement of general public. Apart from this Hon'ble Apex Court has extended a period of limitation up to February, 2022. This application is filed on 25/03/2022. Thus, though the 50.ca14889.22.odt

technically there is delay in filing appeal, the same deserves to be condoned. Hence application stands allowed in terms of prayer clause 'b'. 3.
