Mr.Surwase, learned Counsel for the appellant, tenders a pursis for withdrawal of the appeal. The same is taken on record and marked as "X" for identification. The pursis states that in view of the Government Resolution dated 03.11.2016, Corrigendum dated 13.08.2018 so also the full bench judgment in the Case of State of Maharashtra Vs. Kailash Shiva Rangari and the judgment of this Court in First Appeal Nos.2166, 2169 and 2170 of 2014 dated 29.09.2018 (The Executive Engineer, Nimna Dudhna Project Vs. Shamrao s/o. Bhimrao Gore and ors.), the appellant wants to withdraw the appeal.

Mr.Kakde, learned Counsel for respondent no.1, has no objection for withdrawal of the appeal.

In view of the above, the appeal is disposed of as withdrawn. Civil application, if any, stands disposed of. 5.
