It appears that the reasons assigned in the impugned order are without verifying the factual position as to whether the petitioner has really worked for more than 240 days in a calender year and in all for five years so as to enable him to get benefit of the Government Resolution issued by the Minor Irrigation Department of Government of Maharashtra.

1784.15wp In that view of the matter, we set aside the impugned communication and direct the respondents No.2 to 4 to find out the factual position as to whether the petitioner has worked for more than 240 days in a calender year, for five years. Such exercise to be completed within two months from today and thereafter, respondent No.1 shall take final decision on the proposal of the petitioner. With these directions, petition stands disposed of.
