Heard learned counsel for petitioner and learned Assistant Government Pleader.

It transpires that while petitioner's land had been put under acquisition for rehabilitation purpose, with further developments, quite a few lands were being shown to have been reserved for educational purposes which the petitioner had demanded, petitioner's request to give lands to petitioner has been acceded to on payment of consideration.

In the circumstances, learned counsel for petitioner adverts to that since petitioner had not withdrawn amount of compensation payable to petitioner under acquisition proceedings,

2 WP - 2730-2014 request proposal has been given to the government to appropriate same towards consideration for lands now being given to petitioner and to waive condition of payment of consideration and same is stated to be pending with the government.

In view of aforesaid, it no longer appears to be necessary that present petition be kept pending in this court. It would suffice that the government proceeds with the request / representation given by petitioner referred to above. 5.

It would be appropriate that pending proposal of petitioner be decided as early as possible, preferably within a period of six months from date of receipt of writ of this court. 6.

Writ petition accordingly is disposed of.
