The parties to the dispute have arrived at amicable settlement and tender terms of compromise which are taken on record and marked "X" for identification.

Thereafter, parties were relegated to the learned Registrar (Judicial) of this Court for verification of the terms. Consequently, learned Registrar (Judicial) submitted report dated 3.12.2024 which states that signatories to the compromise are authorized persons. Mr. Manoj Maharu Rathod and Kunal K. Kadam who are Chairman and Secretary of the appellant APMC, Kannad, have signed the terms of compromise. They are identified by Avocate Shri Vikas Jadhav. Similarly, Shri Sunil Ramchandra Kastode who is custodian of respondent APMC,

{2} 908 sr.no..odt has put his signature, who is identified by Advocate G.P. __. 3.

The terms of compromise are approved by the competent authorities. There is no legal impediment for accepting the terms of compromise terms and pass decree accordingly. 4.

In that view of the matter, Second Appeal is disposed of in terms of compromise at "Exhibit X". The decree passed by the courts below are modified accordingly and decree in Second Appeal be drawn in terms of the compromise.
