Present Appeal has been filed by the insurance company challenging the award passed by the Tribunal. Mr. Basarkar, the learned Advocate for the appellant insurance company to whom the authority has been given is present, so also Mr. Bodkhe, learned Advocate holding for Mr. Gore, learned Advocate for respondent No.1 is present. The original claimant - respondent No.1 and the appellant insurance company have arrived at compromise. The compromise terms are taken on record and marked at Exhibit-"A". The appellant insurance company and respondent no.1 have settled the matter as full and final for the

fa3568.22 amount of Rs.3,50,000/-. The insurance company has deposited amount of Rs.3,96,962/- in this Court. Respondent No.1 - original claimant agrees that the balance amount can be refunded to the insurance company inclusive of the interest.

Under such circumstance, the First Appeal would stand disposed of in terms of compromise Exhibit-A. 3.

The award be drawn up in terms of the compromise Exhibit-A. 4.

Claimant - Respondent No.1 would be permitted to withdraw the amount of Rs.3,50,000/-.

The remaining balance amount that is inclusive of interest be refunded to the appellant insurance company.

The Appeal, therefore, stands disposed of, accordingly. 7.
