Heard learned Counsel for applicant and learned Counsel for respondent No.1.

Learned Counsel for applicant submits that, applicant got injured in the said accident. He is unable to do any work, due to the accident. Applicant is facing starvation. Hence, requested to allow application. 3.

Learned Counsel for respondent No.1 submits that, in connected group of appeals arising out of same accident, this Court (Coram : R.G. Avachat, J.) has Pooja K.

{2} 916-CA-14455-2022 permitted applicants to withdraw 40% of the amount deposited in this Court on furnishing solvent security/surety to the satisfaction of the Registrar (Judicial) of this Court. Hence, requested to pass same order.

Considering the submissions of both the learned Counsel as well as order passed by this Court (Coram : R.G. Avachat, J.). This Court has permitted the applicants to withdraw 40% of the amount deposited in this Court on furnishing solvent security/surety to the satisfaction of the Registrar (Judicial) of this Court. Hence, I pass the following order :

ORDER

(a) Application is allowed.

(b) Applicant is permitted to withdraw 40% amount along-with accrued interest thereon on furnishing undertaking to the satisfaction of the learned Registrar (Judicial) of this Court.

(c) The Civil Application is disposed of.
