Pursuant to the advertisement for the posts of CHP petitioners had applied for Parner Sub Centre. The petitioners were selected for training. The six months training was given to petitioners. Orders are issued to petitioners appointing them as CHP at different centres other than the centres which were notified in the advertisement. The same appears to be on the basis of the communication dated 24.06.2019 by the Chief Executive Officer. The Chief Executive Officer passed the said order on the basis of the communication received by him from the Deputy Director, National Health Commission.

It is not disputed that out of 36 posts at Parner 14 posts are vacant. 36 candidates were selected. Out of 36 only 22 passed. The petitioners have passed in first attempt. In view of that, they are required to be accommodated at Parner.

At this stage, one cannot consider the cases of those who have failed. The respondents can take decision in respect of those candidates. However, petitioners have applied for Parner Sub Centre, they have passed in first attempt and are selected, as such they are to be accommodated at Parner. More particularly, when 14 posts are vacant at Parner.

In light of that, respondents shall endeavour to accommodate petitioners at Parner Sub Centre.

Writ Petition is disposed of. No costs.
