Learned counsel for the appellant submits that he contacted the appellant on mobile phone and intimated him that he is required to file an application seeking leave to file appeal and also intimated the date fixed in the matter. He submits that inspite of making sincere efforts to secure the presence of the appellant, the appellant has not contacted him. He, therefore, submits that due to non-cooperation from the appellant he is unable to comply with the order passed in the matter to file application seeking leave to file appeal pursuant to the decision of the Apex Court in the case of Satya Pal Singh Vs State of M.P. and ors .

Learned counsel for the appellant has taken all sincere efforts to secure the presence of the appellant. It appears that the appellant is not interested to prosecute the matter. I am, therefore, inclined to dismiss the appeal in default of appellant to file an application seeking leave to file an appeal as well as non-compliance of the order passed by this Court. The appeal stands disposed of as dismissed for non-compliance of order.
