Heard learned AGP for the applicants. He refers to contents of application and states that it is under the circumstances, delay has been caused. He submits that delay is neither deliberate nor intentional. Same has been caused under the circumstances referred to.

Learned counsel Mr. Chavan purports to resist, however, is not in a position to dispute veracity of contents of the application.

In view of aforesaid and also taking into account delay has been accounted for, it would be expedient to condone the delay.

As such, civil application is allowed in terms of prayer clause (B) and is disposed of.
