Learned Public Prosecutor Mr. D. R. Kale submits that as per the decision dated 19.01.2022 taken by the three members committee headed by the Commissioner of Police, the crime bearing no. 282/2015 vide R.C.C. No. 6901/2016 is now recommended for withdrawal of prosecution in terms of the provisions of Section 321 of Cr.P.C.

Learned Public Prosecutor Mr. D. R. Kale further submits that even the same decision has been taken in respect of crime no. 3002 of 2004. However, at present, the file of the said crime is not traceable in the concerned court. That is why the requisite application in terms of the provisions of Section 321 of Cr.P.C. could not be filed. 950-CriWP-1283-2021 -2Public Prosecutor submits that after reconstruction of the file, if directed by the Court, the said recommendation will be communicated to the Public Prosecutor of the said Court for filing of the application in terms of the provisions of Section 321 of Cr.P.C. as per the Government policy.
