Heard learned Counsel appearing on behalf of the applicant, who is praying for intervention in the matter.

Learned Counsel submits that in identical circumstances, in connected applications, namely, Civil Application No.11157 of 2018 in Writ Petition No.2990 of 2017 and other applications, the order is passed by this Court on 7th September, 2018, a copy of which is also placed on record. As it is not in dispute that the facts in both the matters are identical and the observations made by the Honourable the Apex Court in the latest order dated 23rd August, 2018, in the matter of Shankar s/o Raghunath Devre

ca12806.18 (2) (Patil) vs. State of Maharashtra & ors. in Petition(S) for Special Leave to Appeal (C) No(s) 29874-29875/2016 with connected matters to which we have referred to in our order dated 7th September, 2018, in Civil Application No.11157 of 2018 in Writ Petition No.2990 of 2017 which occupies the field, we see no reason to take a different view than the view which we have already taken.

In view thereof, Civil Application is allowed in terms of prayer clause (B) and (C) and disposed of. The learned Asstt. Govt. Pleader appearing for the State authorities - respondent Nos.2 to 5 to communicate the order of this Court immediately to the Collector, Ahmednagar and Deputy Collector (Revenue), Ahmednagar.
