Having considered the contentions raised, it can be observed that delay is not intentional. The applicant has not derived any advantage by making such delay. Delay appears to be on account of communication gap between the applicant and the advocate and also for taking further steps. 3.

Consequently, civil application is allowed. Delay of 67 days caused in filing the second appeal is condoned. Civil application stands disposed off.
