Learned Additional Sessions Judge, Biloli, by order dated 14th September, 2015, passed below Exh.5, in Misc. Criminal Application No.59 of 2015, refused to grant ad interim pre-arrest bail on 14th September, 2015 to the applicants, which has prompted them to approach this Court. 2.

This Court has protected the applicants by an order dated 7th October, 2015. However, the fact remains that the main application, i.e. Misc. Criminal Application No.59 of 2015 remained pending before the learned Sessions Court.

In view of above, ad interim protection ordered by this Court on 7th October, 2015, stands confirmed till the decision of the learned Sessions Court in Misc. Criminal Application No.59 of 2015.

Learned Additional Sessions Judge shall decide the main application of the present applicants for grant of pre-arrest bail, on its own merits, without being influenced by the observations made herein above. Criminal Application stands disposed of in terms of above directions. (N.W. SAMBRE, J.) amj
