1] Heard learned counsel for the applicant and the learned APP for the respondent-State.

2] The applicant is seeking bail as he is arrested on 28.04.2021 in connection with Crime No. 89/2021 registered with Police Station Shirur, Tal. Vaijapur and Dist. Aurangabad for the offence punishable under Section 307, of Indian Penal Code and in the charge-sheet 302, 323, 504, 34 of Indian Penal Code.

3] Learned counsel appearing for the applicant submits that despite opportunity, the I.O is not appearing during trial.

1758-2024 BA 4] The learned APP submits that only two witnesses are left to be examined in the matter. The applicant is alleged to have been committed murder of the deceased victim.

5] The applicant is in custody from 28.04.2024.

Considering the nature of the allegation, the applicant is granted liberty to revive this bail application, if trial is not concluded within three months.

6] The application is disposed of accordingly.
