ORDER

(9th December, 2023) 1.

Learned counsel Mr. B. R. Survase is present for appellant/acquiring body. Mr. P. D. Dhalwalkar, Sub-Divisional Ofcer, Jalna Minor Irrigation Department, is present. Learned counsel Mr. D. M. Kakade is present for respondents/original claimants. 2.

Both the parties fled terms of compromise on record, which is marked as Exhibit 'X'. They submit that present appeals be disposed of as per above mentioned terms of compromise. In view of the same, present appeals are disposed of as per the terms of compromise. 3.

Parties make a statement across the bar that 75% amount is already deposited. Acquiring body undertakes to deposit 25% amount within a period of six months. In case, the amount is not deposited within a period of six months, it will carry interest in accordance with law. 4.

Respondents are permitted to withdraw the amount already deposited with accrued interest and shall be further entitled to withdraw the 25% amount deposited by acquiring body with interest accrued.

Award/decree be drawn up in terms of compromise. 6.

Court Fees Refund Certifcate be issued as per rules. 7.

No order as to costs.
