09.10.2018 P.C. :- The petitioner is raising an objection to the inclusion of village Pimri-Raja, Tq. Paithan in perspective plan prepared by the University for granting permission to establish senior college. The petitioner is an institution operating senior college in the same taluka and the college is stated to have been established at a distance of about 5 kms from the proposed place included in the perspective plan. The petitioner firstly does not have any entitlement at present to raise an objection to the perspective plan since no cause of action has arisen. Apart from this there are no parameters placed on record facilitating the University to prepare the perspective plan and permit opening of the colleges. There does not appear to be any distance rule which is mandatorily required to be adhered to by the University under the policy either framed by the State Government or by the University or atleast such a

In this view of the matter no interference is called for at this stage of the proceeding. The writ petition is devoid of substance and stands rejected.
