PER COURT :- The learned counsel appearing for the Respondent submits that, the order of termination is already passed. He further submits that, the appeal is provided for the aggrieved employee under Rule 13(e) of the Maharashtra Zilla Parishad District Services (Discipline and Appeal) Rules, 1967.

The learned counsel appearing for the petitioner, on instructions, seeks permission to withdraw the Petition so as to avail the remedy under Rule 13(e) of the said Rules.

The Petition is dismissed as withdrawn, with liberty to the petitioner to take exception to the order of termination before the appropriate authority.

All the issues raised in this Petition are kept open to be agitated before the Appellate Authority.
