Considering the time that has been elapsed in prosecuting the application i.e. M.A.R.J.I. No. 1051/2008 on the file of learned Civil Judge Senior Division, Aurangabad, the present application for condonation of delay deserves to be allowed.

Mr. M.A. Latif, learned counsel for respondent No.1, submits that even the filing of said M.A.R.J.I. was delayed by eleven days.

Considering the reasons stated in the

ca12651-2014 application, the delay is condoned and the present application is allowed with costs. The applicant shall pay cost of Rs. 2000/- (rupees two thousand) to the respondent No. 1 or deposit the said amount of Rs. 2000/- in this Court, on or before 30th July, 2015. [M.T.
