Heard the learned counsel for the parties.

The learned counsel for the petitioner has submitted that the petitioner has deposited entire amount as directed by the Tahsildar vide his order dated 31.7.2023, however, the vehicle of the petitioner is still in the custody of the Tahsildar.

The Tahsildar is directed to release the vehicle forthwith subject to usual undertaking. It is clarified that in the event, separate order is passed by the S.D.O. for wrongful use of the vehicle, the petitioner will have three weeks time to challenge the same before the appropriate authority for obtaining interim relief, if any. However, if any adverse order is passed by the appellate authority, the petitioner will be liable to pay the entire amount as directed by the S.D.O., failing which the petitioner will give an undertaking to surrender his vehicle to the Tahsildar. 4.
