Present petition has been filed for following reliefs :- A) Issue a writ of certiorari or any other appropriate writ, order or direction, quashing the impugned order dated 23.06.2025 bearing No. 6/1035/2025 issued by Respondent No. 1.

B) Declare that the Petitioner is not a Bulk Waste Generator under Rule 3(3) of the Solid Waste Management Rules, 2016 in the absence of supporting audit or data.

C) Direct the Respondent No. 1 to conduct a proper waste audit/inspection before issuing any further direction under the Solid Waste Management Rules, 2016.

Petitioner states that it is a society duly registered under Societies Registration Act, 1860 at Varanasi, Uttar Pradesh. A pilgrimage centre operated by the petitioner at Shirdi, Tq. Rahata, Dist. Ahmednagar. The petitioner is paying taxes including the tax for management of solid waste but still by order dated 23.06.2025 respondent No. 1 has directed the petitioner to compulsorily install an in917-WP-13467-2025.odt

situ solid waste processing unit in its own premise by considering the petitioner is a "Balk Waste Generator" under Rule 3(3) of Solid Waste Management Rules, 2016 and the Shirdi Nagarparishad Waste Management and Sanitation Bye-laws (Amended), 2023. 3.

After making submissions, the learned Advocate for the petitioner seeks withdrawal of the petition with liberty to approach the respondent No. 1 with a representation giving all the details of waste generated at pilgrimage centre of the petitioner and how they are presently managing the waste in view of Clause 4(7) of the Solid Waste Management Rules, 2016 thereupon the respondent No. 1 would take the decision.

In view of the said statement, we allow the petitioner to withdraw the petition. There is no necessity to issue notice to the respondent No. 1 for that purpose.

Learned AGP waives notice for respondent No. 2. 6.

We permit the petitioner to make detailed representation to the respondent No. 1 which should then be decided by the respondent No. 1 as early as possible taking into consideration the matter relates to the waste management.

Hence, Writ petition stands disposed of.
