The applicant has approached this Court apprehending arrest in connection with FIR bearing Crime No. 343 of 2023, dated 05.12.2023, registered with Mhasawad Police Station, District - Nandurbar for the offences punishable under Sections 307, 323, 285, 143, 147, 148, 149, 504 and 506 of Indian Penal Code. 2.
The learned APP objects to the maintainability of the present application on the ground that the applicant had earlier withdrawn his anticipatory bail application, which was filed even after filing of the charge-sheet.

I have considered the order dated 12.08.2024 passed by this Court, wherein the applicant - Jitendra Pawar had withdrawn the anticipatory bail application being ABA No. 209 of 2024, which had Jhs/ 1/2
936 ABA NO. 1609 OF 2024 been filed by him along with other co-accused, who were granted anticipatory bail.

Perusal of the order dated 12.08.2024 shows that this Court was not inclined to grant anticipatory bail to the present applicant - Jitendra Pawar. Consequently, upon instructions, learned counsel for the applicant sought liberty to withdraw the application, which was accordingly granted, and the application insofar as it concerned the present applicant stood withdrawn.

Thus, the second successive anticipatory bail application filed by the applicant is not maintainable. Even otherwise, considering the merits of the case, there are direct allegations against the applicant of assault by means of a broken glass bottle. The corresponding injury is supported by the medical certificate, and the opinion of the Medical Officer indicates that the incised wound on the right side of the victim's forehead could be caused by a broken glass. The spot panchanama also reflects the presence of broken glass pieces at the scene. In view of these circumstances, I am not inclined to entertain the present anticipatory bail application of the applicant - Jitendra Pawar. The application, therefore, stands rejected. 6.
