Mr Bolkar, the learned counsel for the petitioner submits that, the impugned communication dt. 10.08.2016 is illegal, null and void. The petitioner is issued with the Project Affected Person's Certificate. His application ought to have been considered for appointment in Government Service suitable to his educational qualification.

We have heard learned Assistant Government Pleader. 3.

In view of the judgment of the Full Bench of this Court in the case of Rajendra Pandurang Pagare & Anr vs. The State of

2 99WP10089.2018 Maharashtra & Ors. reported in 2009 (4) Mh. L. J. 961, the person possessing Project Affected Persons Certificate also has to come through proper competition. The direct appointment cannot be given.
