The Petitioner challenges the judgment and order dated 26th August, 2009 delivered by the learned Maharashtra Administrative Tribunal Bombay, Aurangabad Bench, Aurangabad in Original Application No. 594 of 1998. It is conceded that the Petitioner had approached the Industrial Court in Complaint (ULP) No. 42 of 2012 for seeking regularization. The said complaint is still pending before the Industrial Court, Aurangabad.

We would not entertain this Petition for two reasons. Firstly that a verdict of the learned Tribunal is sought to be challenged after 14 years and 6 months. Secondly, the complaint preferred by the Petitioner before the Industrial Court is still pending. 11.wp835.22.odt

This Petition is, therefore, disposed off. However, we deem it appropriate, in the interest of justice and kindness, to direct that the learned Industrial Court at Aurangabad would decide the pending complaint as expeditiously as possible and preferably on or before 30th June, 2024.
