I have heard the learned Advocates for the respective sides. 2.

The LR's of deceased respondent No.7 Yogesh Pandharinath, who has passed away, are served. Respondent No.7A Vimal is the widow of deceased Yogesh and Hemant and Poonam are the minor biological children.

Considering the above, this civil application is allowed. 4.

The petitioner shall bring the LR's of deceased respondent No.7, on record, on or before 13/03/2020 and shall deposit an khs/Feb.2020/11452-d

- 2 - amount of Rs.1,000/- for condonation of delay of 1065 days, with the Government Medical College and Hospital, Aurangabad, through Medical Officer, High Court Dispensary, Aurangabad, either in cash or by Demand Draft (Demand Draft be drawn in the name of "Dean, Government Medical College and Hospital, Aurangabad Dengi Samiti"), within the same period.

Office to issue notice in the writ petition to the LR's of deceased respondent No.7, through respondent No.7A, returnable on 23/03/2020. Parties to note that this petition is likely to be heard finally on the returnable date. Notices will be served on the LR's of deceased respondent No.7 by paper publication in Dainik "Divya Marathi" Jalgaon Edition, at least 10 days prior to the returnable date in this matter.
