Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.214 of 2023 registered with Nimbhora Police Station, District Jalgaon for the offences punishable under Sections 302, 201 r/w 34 of the Indian Penal Code.

The applicant was not named in the FIR. The report was against the unknown person. There is no cogent and reliable evidence that the applicant was lastly seen with the deceased. One stick and blood stained shirt has been recovered. Its C.A. report is awaited. Considering the material collected against the applicant and the completion of investigation, the applicant deserve bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Arjun Narsing Bhil, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that ;

(a) The applicant should not tamper with the prosecution witnesses and should attend the trial on each and every effective date.
