Learned counsel Mr. S. R. Bodade for the appellant/Insurance Company, learned counsel Mr. Joyeb Shaikh for the respondent No. 1/original claimant along with original claimant are present today. They tender on record terms of settlement, which is taken on record and marked as 'Exhibit - X' for identification.

With the assistance of learned counsel for the parties, we have ascertained the identification of the original claimant/respondent No. 1. He confirms the terms of settlement and agrees for the final disposal of the first appeal as per the settlement.

The first appeal stands disposed of in terms of settlement Exhibit - X.

As per the settlement between the parties, the appellant/insurance company shall be paid an amount of Rs. 1,00,000/- (Rs. One Lakh only), which is already deposited in this Court by the Insurance Company. Balance amount along with accrued interest shall be disbursed to the respondent No. 1/claimant towards full and final settlement. 6.

A request for refund of court fees shall be processed in accordance with law.
