Heard learned counsel for the applicant and learned APP for the State.

The applicant is languishing behind the bar for about six years. Only four witnesses have been examined. The prosecution has cited 49 witnesses. Long list of witnesses would take the time to complete the trial. The co-accused having similar roles have been released by this Court.

Considering the length of incarceration, the application is liable to be allowed. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Ramnath @ Dadu Gorakh More, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with Crime

939-ba-1753-2022.odt (2) No.132 of 2017, registered at Rahata Police Station, District Ahmednagar for the offence punishable under Sections 397, 392 read with Section 34 of the Indian Penal Code, Sections 3/25, 4/25 of the Indian Arms Act and Sections 3(i) (ii), 3(2) and 3(4) of the Maharashtra Control of Organised Crime Act, 1999, on the conditions that ;

(a) The applicant shall not tamper with the prosecution evidence.

(b) The applicant shall attend the Rahata Police Station everyday between 8.00 a.m. to 9.00 a.m. and 11.00 a.m. to 01.00 p.m. till conclusion of the trial.
