BENCH AT AURANGABAD.

32 WRIT PETITION NO. 2101 OF 2016 THE PRESIDENT UNNATI MITRA MANDAL DHULE AND ANOTHERS

VERSUS

MILIND RAMESH VARULE AND OTHERS ...

Advocate for Petitioners : Mr. Mukul S. Kulkarni AGP for Respondents: Mr. V.S. Badakh ...

CORAM : R. M. BORDE, J.

Date: March 28, 2016 ...

PER COURT :- The petitioner management is taking exception to the order passed by the School Tribunal, condoning delay of about 16 days occurred in presenting an appeal by an employee, challenging the order passed by the management, directing termination of his services. We have perused the order passed by the Trial Court. The employee approached the Court late for the reason that he was suffering from mental shock. The paltry delay of 16 days occurred in approaching the Tribunal has been condoned by the School Tribunal subject to payment of costs of Rs.500/-. The order passed by the Tribunal serves the ends of justice. Had it been reverse situation, then it was a case for interference in the matter. The petition is devoid of substance and hence stands dismissed.
