PER COURT :- The learned counsel appearing for the petitioner, on instructions, makes a statement that, the petitioner will make comprehensive representation to Respondent Nos. 1 and 5, relying upon outcome of the Original Application Nos. 288, 289, 314 and 387 of 2009 in the case of Shri. Ramesh S/o Ganpatrao Kshirsagar and others V/s The State of Maharashtra and others decided on 1st October, 2010, on the ground that, the applicants therein were similarly situated employees like the petitioner and though they have been granted benefit, however, the petitioner is denied the same.

The comprehensive representation be filed within three weeks from today accompanied with the aforementioned judgment of the Maharashtra Administrative Tribunal and any other documents relevant

10361.14wp to the case of the petitioner. In case, such comprehensive representation is filed by the petitioner with Respondent Nos. 1 and 5, they are directed to decide the same as expeditiously as possible, however, in any case, within three months from receiving the representation of the petitioner. Needless to observe that, Respondent Nos. 1 and 5, if feel it appropriate to hear the petitioner, they should afford the opportunity of hearing to the petitioner.

In case, the decision of the Respondent Authorities is not favourable to the petitioner, the petitioner will be at liberty to take exception to such decision before Maharashtra Administrative Tribunal, Mumbai bench at Aurangabad.

The Petition is disposed of on above terms.
