The challenge raised in this petition is in respect of rejection of the proposal by the State Government and the communication issued by the University in the year 2016-2017. The said proposal was tendered for commencement of the College for the academic year 2016-2017.

It is informed by the learned Counsel appearing for the petitioner that fresh advertisement has been issued for according permission to operate college during the academic year 2019-2020. The petitioner has an apprehension that in view of rejection of earlier proposal, fresh proposal by the Institution may not be considered.

The apprehension is misplaced. It would be open for the petitioner to tender fresh proposal in response to the

{2} wp1091518.odt advertisement issued by the State for operating college during the academic year 2019-2020 and if the petitioner tenders the proposal, same shall be dealt with on its own merits and without being influenced by the earlier decision of rejection of the proposal tendered by the institution for the academic year 2016-2017. With the directions as above, writ petition is disposed of.
