1) Learned Counsel appearing for the parties jointly submit that the dispute between the appellant and respondent has been amicably resolved. Learned Counsel for the appellant submitted that now it is resolved between the appellant and the respondent that out of the disputed portion, East-north corner portion of 7 1⁄2 X 30 ft will now be permanently in possession of the appellant and the balance portion of 22 1⁄2 X 30 ft will remain in possession of the respondent as owner.
2) The parties are present before the Court and they have admitted the fact of amicable settlement of the dispute between them.
3) In view of the submission so made and the affidavit filed by the appellant, the appeal is permitted to be withdrawn and disposed of as such. Pending Civil Application stands disposed of.
