The applicant apprehends his arrest in Crime No. 632 of 2022 registered with Shevgaon Police Station, Shevgaon, District - Ahmednagar for offence punishable under section 7 of the Prevention of Corruption Act.

The FIR is lodged by Hanumanta Ankush Zade, alleging that Talathi of the Tahsil office asked the informant to pay bribe amount of Rs.500/- to the applicant, who is working as Revenue Assistant in Tahsil Office, Shevgaon, for effecting mutation entry on the seven twelve extract. Accordingly, trap was laid, however the applicant did not accept the bribe amount.

Heard learned advocate for the applicant and the learned Additional Public Prosecutor for the State. Perused the investigation papers.

Perusal of the investigation papers shows that the investigation is almost complete. The applicant was granted interim protection and he has co-operated in the investigation. Pre-trial custodial detention of the applicant is, therefore, not necessary in the facts of the present case.

The application is allowed by confirming the interim order. Till filing of the charge sheet, the applicant shall attend the concerned police station as and when called by the Investigating Officer. The applicant shall not tamper prosecution evidence. [NITIN B. SURYAWANSHI] JUDGE drp/aba1398-22
