Learned Advocate appearing for the petitioner, on instructions, seeks permission to withdraw the writ petition with liberty to move appropriate application before the learned Magistrate for modification of the order on the basis of subsequent event i.e. deposit of his passport with police station and consequently losing his earning.

Learned Advocate for the petitioner further undertakes that the the petitioner will not seek any adjournment in pending appeal before the Sessions Court and he shall positively argue the matter on the next of hearing fixed.

In view of above, writ petition is disposed of as withdrawn with liberty as above.
