DATE: 23rd October, 2018 PER COURT:- Heard learned Counsel for the applicant and learned Counsel appearing for the Acquiring Body as well as learned AGP appearing for the State.

In view of the submissions made by the learned Counsel for the parties, the following order is passed:-

ORDER

I) The applicant is permitted to withdraw 60% of the deposited amount on submitting an undertaking to the satisfaction of the Registrar (Judicial) of this Court.

{2} 925 CA 12960 OF 2018 II) Balance 40% of the deposited amount be invested in the Fixed Deposit Receipt in any Nationalized Bank till decision in the appeal. III) Call Record and Proceedings.

IV) List the matters for final disposal on 03.12.2018.
