Considering the averments made in the in the application for withdrawal of the amount and having regard to the grounds of objection raised by the appellant Insurance Company in challenge to the impugned judgment and award, I deem it appropriate to pass following order:

ORDER

1.

The applicants are permitted to withdraw 70 per cent of the amount deposited in this Court on submitting an undertaking that if any adverse order is passed in the appeal, the applicants will re-deposit the amount so AGP/-

IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD (2) CA NO.13624/2016 withdrawn within four months of passing of such adverse order. Balance amount be invested in a Fixed Deposit Receipt in any Nationalized Bank initially for a period of two years and, if required, for further period till disposal of the appeal.
