1] By the present Writ Petition, the petitioners challenge the order dated 03.09.2025 passed by the 2nd Joint Civil Judge Senior Division, Bhusawal below Exh.17 in Special Civil Suit No.63/2025 wherein the trial Court has vacated the status-quo considering that the suit property is transferred to the third party.

2] The learned counsel for the petitioners submits that there are 7 properties mentioned in the suit of which one property is transferred to the third party. He further submits that except Gat No. 225/1, there is status quo order operating till 1st October, 2025 and the matter is fixed for hearing on 1st October, 2025.

11530.25WP 3] The original defendants submits that they would appear before the Civil Court and contest the matter on 1st October, 2025.

4] The trial Court may pass an order in the application below Exh. 6 in Special Civil Suit No.63/2025 after hearing all the parties. As regards, added defendants are concerned, the petitioners are at liberty to take steps as available in law.

5] In view of the above, the Writ Petition is disposed of. This Court has not decided anything on merits, all contentions of the parties are kept open. [ARUN R. PEDNEKER] JUDGE DDC
