1] Learned AGP waives service of notice for the respondent nos.1 to 3.

2] Learned counsel for the petitioner submits that the proposal has been submitted by the present respondent no. 5 seeking approval to the appointment of the petitioner from non-aided post to aided post. The same is submitted in January, 2016. However, no decision has been taken on the said proposal as yet. The policy of the Government pursuant to the Government resolution dated 20.6.2016

WP 10641/16 - 2 - permits a teacher working on non-aided post to be posted on aided post if the vacancy arises.

3] Learned AGP submits that in case the said proposal is pending with the Education Officer, the same would be decided on its own merits in accordance with law and policy.

4] Considering the above, we pass the following order.

O R D E R

a] The respondent no.3 shall decide the proposal, if pending with him, (Exhibit H page 21) on its own merits in accordance with law and policy, expeditiously and preferably within four months. b] Writ petition is accordingly disposed of. No costs.
