The petitioner has challenged the order dated 22/08/2012 delivered by the Labour Court in Complaint (ULP) No.31/2006 below Exh.C22, as well as the judgment of the Industrial Court dated 20/09/2014 by which Revision (ULP) No.57/2012 was dismissed. 2.
Grievance of the petitioner is that the respondent was terminated on 02/05/2002 without any enquiry. The petitioner, therefore, sought leave to conduct an enquiry before the Labour Court by application Exh.C22. Same is rejected by the Labour Court and the Revision is dismissed by the Industrial Court. 3.
Mr.Patil, submits on instructions that Complaint (ULP) khs/Sept. 2015/3214d
No.93/2006 has been partly allowed on 05/09/2015. The petitioner intends to challenge the final judgment before the Industrial Court u/s 44 of The M.R.T.U. and P.U.L.P. Act, 1971. He, therefore, prays for liberty to withdraw this petition so as to raise proper grounds by way of a comprehensive challenge before the Industrial Court. 4.
In the light of the above, the petitioner is permitted to withdraw this petition and raise a comprehensive challenge in the Revision Petition. Contentions of all the litigating sides are kept open. 5.
