Mr. Choudhari, the learned counsel on instructions submits that, subsequently suit of the present petitioner stands dismissed.

The averments of contempt are on the basis that this Court had granted injunction and had directed that injunction granted by the Trial Court shall continue. However the respondents obstructed possession of the petitioner. The police complaint was also filed to that effect and criminal case was lodged against those persons.

Considering the fact that, civil suit is dismissed and also the fact that, all these aspects would require evidence, the present contempt petition is disposed of.

Needless to state, if, the petitioner has any other remedy available at his disposal, the petitioner is at liberty to avail the same.
