Despite service of notice, respondents No. 2 and 3 did not secure their presence in this application for condonation of delay. 2.

Heard learned Counsel for appearing parties.

This Court under order dated 14th October, 2016 directed the applicant / appellant - Corporation to deposit entire amount of compensation awarded by the learned trial Court. 4.

Mr. Dande, learned counsel for applicant - Corporation submits that pursuant to order of this Court the entire amount of compensation has already been deposited and hence requested to condone the delay.

The learned Counsel for respondents No. 1 to 3 and learned AGP have no objection for condonation of 138 days delay caused in preferring the appeal against impugned Award passed by the learned Trial Court.

In view of attending circumstances and for the reasons stated in the application, there is no impediment to condone the delay. Accordingly, application stands allowed in terms of prayer clause "A". Registry to take requisite steps for further process. 7.

After registration, list the appeal on 06-09-2017 for hearing.

The civil application is allowed in aforesaid terms and stands disposed of accordingly.
