The petitioner possesses a certificate of validity issued pursuant to the order of this Court dated 01 August 2023. This Court had expressed that his validity would be subject to the final outcome of the matters which the Committee had decided to reopen. The Scrutiny Committee issued the certificate of validity, however, by impressing therein is the title 'Conditional Validity'. 3.

We have already considered a similar issue in Civil Application No. 10185 of 2023 in Writ Petition No. 4975 of 2023 by the order dated 17 August 2023.

For the same reasons, we allow the Writ Petition and direct the Scrutiny Committee to issue a certificate of validity strictly in from 'G' without putting any additional condition.

However, if the Committee is unable to issue a fresh certificate of validity, all the stakeholders / the respondents shall treat the certificate of validity serial no. 146474 (exhibit 'B') as the certificate of validity for all practical purposes. 5.

Learned Advocate Mr. Bayas, who is representing the respondent no. 2 - MUHS, Nashik, shall convey this order to MUHS which shall release the documents/certificates of the petitioner, immediately.

Writ Petition is disposed of.
