Heard learned counsel for respective parties. 2.

By way of present petition, the petitioner challenges the order dated 17.08.2022 passed by the learned Additional Commissioner, Aurangabad in File No.2021/ROR/Rev./33 filed by respondents.

Mr. Natu, learned counsel for respondent no.1 raised a preliminary objection about maintainability of the writ petition by pointing out that against the order passed under review, the petitioner is having an alternate remedy of filing an appeal before the State Government under Section 249 of the Maharashtra Land Revenue Code.

In view thereof, the petition stands disposed of as not maintainable. The petitioner is at liberty to file appeal before the State Government within a period of six weeks from today.

The time spent while prosecuting the present petition shall be taken into consideration by the State Government while considering the application for condonation of delay. If the petitioner files an appeal before the State Government, the State Government is directed to decide the same within a period of six months thereafter. 6.

All points kept open.
