DATED : 07th NOVEMBER, 2025 PER COURT :- CIVIL APPLICATION NO. 10442 OF 2025 This is an application for permission to withdraw the amount deposited by the respondent/M.S.R.T.C. in this Court. Perused the application. Heard the Advocates for both the sides.

Considering the fact situation of the case, it would be proper to partly allow the application by permitting the applicant to withdraw 60 percent amount out of amount deposited in this Court along with interest accrued thereon. Hence, following order:

Civil Application is partly allowed.

b.

Applicant is permitted to withdraw 60 percent amount out of the amount deposited by the appellant in this court alongwith interest accrued thereon by furnishing usual undertaking to the satisfaction of the learned Registrar (Judicial) of this Court.

CIVIL APPLICATION NO. 1686 OF 2025 This is an application for condonation of delay of 338 days caused in filing the present appeal.

Perused the application. Heard the Advocates for both the sides.

Considering the reasons stated in the application, particularly due to administrative exigencies the delay is caused and it is not deliberate, the application deserves to be allowed in the interest of justice. Hence, following order:

ORDER

a.

Civil Application is allowed.

b.

Delay of 338 days caused in filing the appeal is hereby condoned.

-3FIRST APPEAL (ST) NO.4475 OF 2025 Issue notice to the respondents, returnable on 28.11.2025. Learned Advocate Mr. P. C. Mayure waives service of notice for respondent no.1.

Call Record and Proceeding.

Learned Advocate for the appellant is permitted to delete the respondent no.2/Driver of the offending vehicle. 4.

Amendment be carried out within one week.
