I have heard the learned Advocates for the respective sides. The Applicant/ original Petitioner prays for condonation of delay of 263 days in filing this Civil Application seeking restoration of the Writ Petition, which has been dismissed for non removal of office objections on 23.11.2016.
Considering the submissions of the learned Advocates and for the reasons set out in the Civil Application, the same is allowed and delay of 263 days is condoned subject to the following two conditions:- (a) The Applicant shall deposit costs of Rs.5000/- (Rupees Five Thousand) and by the consent of the Respondents, the said
*2* amount shall be deposited with the Advocates Association's Bar Library, High Court, Aurangabad within THREE WEEKS from today.
(b) After the above amount is deposited and after all office objections are removed within THREE WEEKS, the Writ Petition shall stand restored to the stage at which it was dismissed.
Needless to state, either of the two conditions mentioned above are not complied with, this order shall stand recalled, this Civil Application shall stand rejected and the order dated 23.11.2016 shall then stand restored.
