Heard respective counsel.

By the present civil application applicant seeks permission to produce documents and dispose of the writ petition by directing the respondent authorities to consider the applicant for promotion and other consequential benefits within stipulated time.

Learned counsel for the applicant submits that during the pendency of this petition a proposal was submitted by the respondent No. 2 for grant of approval to the promotion and relaxation of educational condition. The Deputy Secretary,

2 ca 13847.24 Urban Development Department, Maharashtra State by his letter dated 04th October, 2023 has granted approval to the proposal of the respondent No. 3. On the basis of above letter, the respondent No. 2/Commissioner by his letter dated 25th January, 2024 has issued order of relaxation of educational condition as well as grant of benefit to the employees and also to consider the employees for promotion.

Since the positive action has been put into motion. The learned counsel for the respondent No. 2 i. e. Commissioner has no objection to dispose of the petition. Hence the civil application is allowed in terms of prayer clause 'B'.

In view of the same the Writ Petition No. 12969 of 2019 stands disposed of.
