Parties to the family court appeal viz; husband and wife have entered into settlement and have compromised the dispute and the terms have been settled and written down. Learned counsel for parties have tendered across those terms and conditions dated 24th February, 2021.

Learned counsel for parties state that the terms and conditions of the compromise have been explained to the parties, they have appreciated and understood the same and out of their free will, have entered into the same. Terms have been verified in the high court. Learned counsel further state that the terms are not unconscionable and are not against any public policy. 3.

Learned counsel for petitioner hands over to learned counsel for respondent a demand draft for a sum of Rs. 8,71,000/-

2 FCA / 76 / 2019 (Rupees Eight Lakh Seventy One Thousand), as referred in term no. (I) of the compromise terms and conditions dated 24th February, 2021.

Respective learned counsel identify their clients and state that the parties are before the court.

Having regard to the terms of compromise, it appears to be expedient that the family court appeal be disposed of in terms of the compromise settled by and between the parties as shown in the compromise terms and conditions which are verified on affidavit. 6.

As such, family court appeal is disposed of in terms of compromise terms and conditions dated 24th February, 2021. 7.

Parties hereto shall appear before the family court at Aurangabad on the day and date of their convenience before 15th March, 2021 and file appropriate proceedings, as referred to under the compromise terms and conditions dated 24th February, 2021.

The record and proceedings be sent back to the family court, Aurangabad forthwith.
