The Applicants, who are the legal representatives of the deceased Respondent No.1 in the Second Appeal, pray for an early final hearing in Second Appeal No.450/2004.

The Second Appeals instituted from 1991 onwards are pending final hearing and are being taken up on every Thursday. As such, precedence cannot be given to this Second Appeal at this stage. In the light of the above, this Civil Application is rejected. However, the Applicants are at liberty to renew their request for an early hearing after six months.

The Applicant, by this Civil Application, prays leave to bring on record the legal heirs of the deceased Respondent No.1/5/F, namely, Sudhir Mahadev Sable.

There is no delay in preferring this Civil Application. The learned Advocate for the Respondents does not oppose. The legal heirs of the deceased Respondent No.1/5/F (1 to 4), though served, have chosen to remain absent.

*3* In the light of the above, this Civil Application is allowed. The Applicant/ Appellant shall bring on record the legal heirs of the deceased Respondent No.1/5/F within a period of THREE WEEKS from today. (RAVINDRA V. GHUGE, J.)
