The applicants are convicted by the learned Magistrate in Regular Criminal Case No. 29 of 2004 for an offence punishable under Section 379 of the Indian Penal Code awarding sentence of simple imprisonment for three months.

The applicants submit that they were on bail during trial, so also during the pendency of appeal, as the appellate Court had confirmed the order of conviction.

Apart from above, according to the applicants, there are no criminal antecedents against them.

In view the above, the applicants are admitted to bail on the terms on which they were released by the Trial Court. The sentence awarded against the applicants stands suspended.

The application stands disposed of.
