The petitioner claims to have belonged to 'Koli Malhar' Scheduled Tribe. The Scrutiny Committee declined to grant validity certificate to the petitioner. He is therefore before us.

Heard. The fact is that this Court vide judgments and orders dated 18.12.2020 and 23.10.2024 passed in Writ Petition No. 8435 of 2020 and Writ Petition No.11834 of 2024 respectively granted conditional validity certificates to the petitioner's real sister and brother. In such circumstances, learned AGP may have reservation to allow the Writ Petition. The only course open for us is to grant the petitioner validity certificate on the very terms and conditions on which his blood relations have been granted such validity certificates. Hence the following order :- :: ORDER ::

i.

The Writ Petition is allowed.

The impugned judgment is quashed and set aside. iii.

Respondent-Scrutiny Committee shall issue the Validity Certificate tot he petitioner of 'Koli Malhar' Scheduled Tribe. iv.

The Validity Certificates would be subject to the decision that would be taken by the Committee in the proceedings re-opened of the validity holders relied by the petitioner.

v.

The Writ Petition is disposed of.
